Hi there,

This is an old issue that was never solved in readybites. EU VAT plugin is not EU law compliant and is easy to bypass or leave empty.
1. BUG, Users can purchase without selecting the country.
2. FAIL, Users can bypass TAX by selecting a country outside EU.
3. FAIL, according to EU law TAX must be applied if purchase is done inside EU zone. That applies to USA or any other country outside EU that are in EU at the time of purchase. It's not up to the user to select the country.
Example, USA citizen is on vacation in Europe, he makes a purchase online with his address in USA... TAX must still be applied since the purchase was done in Europe zone. Basically you can not allow users to select country to apply tax.... tax must be done via geo-ip. User should only be allowed to insert address and country for billing purposes not tax.

Please fix this, I'm constantly loosing money because of tax.
Hello,

We will check this issue and update you.

Hello RRobert & TechGasp,

We already released this fix in Payplans Eu-Vat app version 3.6.4. Let me know the version you are using at your site.

If you are using latest version of Payplans EU-Vat app , then please update me your site details with ftp also. I need to check the other app configuration also which is working on invoice checkout app and causing this issue. Add your site details to your profile , so when you submit a support post into our forum, no need to enter again site details.

Hi Manisha,
I've just testing your latest patch for this app and it appear that user still can bypass country selection. However, the previous patch this issue was solved. Regarding EU requirement about taxes, id like suggest you to refer to some legal text here VAT Tax Rules

And these text about penalties : penalty and this penalty2.

So as this topic is very important i suggest you to report it in order to strengthen this app as suggested by Techgasp in his first post. And then sell it as an extension apart from Payplans (personally, i'd like to pay more rather then going in jail!).

Regards

Thanks for the input on this Robert, it's pretty tricky to enforce country selection as it would need to be based on the IP address of the user.

I am not really sure how are merchants enforcing this but when I tested most of the payment gateways around, when switching the currency / country, the taxes are added / removed depending on the country that I selected.

I am also dealing with the same issue.

Company located in Europe and is selling online services globally. As far as i know, the information required to be on an invoice are the following:

Full VAT invoices

Information required in all cases
1. Date of issue OK EXISTS

2. Unique sequential number identifying the invoice EXISTS BUT DOES NOT SHOW ON INVOICE (needs php modification)

3. Customer’s VAT identification number (if the customer is liable for the tax on the transaction) OK EXISTS

4. Supplier’s full name & address OK EXISTS (set on PayPlans configuration)

5. Customer’s full name & address DOES NOT EXIST !!!

6. Description of quantity & type of goods supplied or type & extent of services rendered OK EXISTS

7. VAT rate applied DOES NOT EXIST !!!

8. VAT amount payable EXISTS

9. Breakdown of VAT amount payable by VAT rate or exemption DOES NOT EXIST !!!

10. Unit price of goods or services – exclusive of tax, discounts or rebates (unless included in the unit price) EXISTS

I believe that Getting the users address and country from EasySocial database and inserting them to EU-VAT app is not a big deal for the people that created the EU-VAT App.

Someone registers and he is registered with an Address! I believe that we all have an "accept terms" during registration that mentions that the info are correct. OK Mr new user, you are taxed according to the address you registered with. You have accepted our terms and conditions and the address you provided is true.

So we make the calculations to the tax according to the address that you registered with without being able to change your country during payment.

If you move to another country, change it through your EasySocial account.

Thank you for reading my opinion.
