I wanted to know if it was possible to make sure that a user can write a debate only if you accept the terms of use

Hello Stefano,

We don't actually have the terms and conditions box when submitting a new discussion currently.

Hello Stefano,

You don't really need a "custom field" but you need to customize the new post form so that it checks for the terms and condition
