Hi there,

what I would be interested in: If you integrate a feature into EasySocial on behalf of a customer against payment (customization offer), this customer, because he has paid, should have the exclusive rights to this modification.

Couldn't this lead to problems if Stackideas should get the idea to integrate this feature into ES as well?

Hello Volker,

It really depends on the feature that is being requested. If it is something that is worth adding into the core, customers would normally share the cost with us and allow us to include the codes into the core. This way, they do not need to worry about maintaining these custom codes themselves.

Then there is the question of how the whole thing is handled in cases where the customer places a customization order, pays for it entirely on his own, and rejects a cost-sharing offer from Stackideas, e.g. because he had previously pointed out a desirable functionality several times, but it was not implemented. In this case, he would have the exclusive rights to the function in question and other ES customers would be left out in the future.

Yes, he will have the exclusive 'feature' on his site where other ES customer's site do not have since he is paying for the customisation. However, please bear in mind that, since the customisation is not added into ES as core feature, meaning to say, he will no longer be able to upgrade his EasySocial to newer version in the future.

Of course he can request us (StackIdeas) to merge his customisation with the new ES version and StackIdeas will charge him for the code merging service.

... or the customer simply puts/adapts the customized code into the new ES version manually each time.

As a result, the above answers mean that, in principle, anyone can block the future integration of important features into ES by commissioning them themselves and paying for them all themselves.

A risky story ...

Hello Volker,

I think there is some confusions here. What my colleague meant in terms of "exclusive" is that the codes that we supplied is exclusively for you, and no body else would have the same codes.

However, it does not mean that we will never ever implement such functionality.

So an exclusive feature and not an exclusive code (for this feature)!

According to your post you could just run an obfuscator over the paid customized code and the code wouldn't be the same anymore!

I think there are some confusions but in short, we do not sell intellectual rights. We are only providing customization service and if you do not agree to the terms, then you shouldn't proceed with it.

In short, this is what I would describe as exclusive rights for you:

1. We develop a feature that is solely available to you at the point of time.

2. If down the road we decide to ever write similar functionality, you do not own such rights to prevent us from doing so.

3. We can never obfuscate our codes, it's open source

4. There is no reason for us to add the code back into the core unless we find it useful in the first place.

Sounds fair and if you want some extra features on top of ES you can if you want hire your own developer that do and maintain that extra codebase that you need extra for your project.
